Terms of Service

Adventure & Landscape (A&L) agrees to the following Terms & Conditions with the client. It is imperative that these are read carefully and fully understood before booking.  These Terms & Conditions constitute a binding contract between A&L and the client, for the services provided by A&L. By booking with us and paying the non-refundable initial deposit or full payment for the services you have requested, you acknowledge that you have read and understood and that you agree to these Terms & Conditions. 

INSURANCE: Adventure & Landscape requires that you take a suitable comprehensive medical and travel insurance prior to trip departure.  It must cover accidents, medical costs and repatriation, as also the costs for loss of baggage, hurt or theft. It must be appropriate for your age, nationality and work in the countries you are travelling in. 

SERVICE: All services are subject to availability, and conditions subject to political and external conditions. 

WEATHER: All tours may be cancelled or modified if weather conditions do not allow the proper functioning or safety of the tour. 

RESPONSIBILITY AND RISK ACCEPTANCE FORM To participate in certain activities guests must sign a responsibility and risk acceptance form prior to participating in any activity. Guests who are 18 years and older sign their own responsibility and risk acceptance form. Guests under the age of 18 must have a parent or legal guardian sign on their behalf. 

LIMITATION OF LIABILITY A&L acts as a booking agent in matters relating to hotel and lodge accommodation, tours and other independent contractors providing transportation and/or other services, each of which is an independent corporation outside A&L’s control and each of which has its own terms and conditions. As such, A&L shall not be liable for injury, delays, loss or damage in any manner.

A&L reserves the right to employ sub-contractors for all or part of its services; in the event of such right the terms of this clause apply.

Whilst every care is taken, A&L cannot be held responsible for loss or damage to baggage.

We do not assume responsibility for airlines and accommodation providers or for any loss, damage, death, injury or expense (including loss of money paid in advance), which you may incur as a consequence of the acts and omissions of others. A&L will not accept responsibility or liability if you contravene any law or regulation of any country or region visited. Any independent arrangements that you make that are not part of the A&L trip (including pre- and post-accommodation) are entirely at your own risk and A&L cannot and does not give you any assurance, representation or warranty in connection with any such arrangements. 

PRIVACY A&L does not use your private information for anything other than booking activities and tours with A&L or any of our third-party activity suppliers. A&L does not share your information with other companies and our team is committed to protecting your privacy. 

BOOKING & PAYMENT Once we agree on your itinerary and price, we will send a Pro-Forma Invoice with quote, trip details and payment instructions, that might vary depending on the nature of each trip. All trips should be paid in full prior to the beginning of each trip.

BANK WIRE AND CREDIT CARD FEES: A&L shall not be responsible for wire transfer or credit card charges. 

EXTRA FEES: International airfares, passport and visa fees, travel insurance, excess baggage charges, airport taxes, gratuities to leaders and guides, extra meals, laundry, extra & alcoholic drinks, medical expenses, optional activities and trips, and other items of a personal nature are not included in your trip price.

 

CANCELLATION & REFUNDS

All cancellations must be made by email with the name of trip/travellers + TRIP CANCELLED in the Subject line, and are effective upon confirmed receipt in our office. Refunds take 2 to 3 weeks to process.

Fees to apply in case of cancellation:

Up to 91 days prior to the departure 25 % of the trip price, between 90 and 61 days 40 % of the trip price, from 60 to 31 days 60 % of the trip price, less than 30 days 100 % of the trip price.

For services not provided directly by A&L, refunds are subject to third parties’ cancellation policy. Further, A&L will not refund any deposits that have been advanced to third parties on client’s behalf for a trip component.

Should you cancel your reservation once the initial reservation deposit is paid, the entire amount is transferable as a future trip credit, to be used by the same traveller/s on a trip departing within 12 months of the original trip cancellation date. This credit cannot be extended beyond 12 months and can be postponed only once. The new resulting trip might be different from the original trip, resulting in a new quote. If hotels and third party services have been already paid at time of cancellation, the same hotels and services should be used in the new trip.

 

CHANGES TO YOUR TRIP Local conditions in Latin America countries are not always predictable and from time to time delays and diversions from the planned itinerary could happen. Should such an instance happen, A&L shall do its best to minimize inconvenience. However, A&L does not accept any responsibility or compensation for delays, loss or extra expenses resulting from circumstances or events beyond A&L control.       

CURRENCY FLUCTUATION Currencies fluctuate constantly. Therefore, and in the case of exceptional cost increases beyond our control, it may be necessary for us to modify the tour cost any time before departure if there are significant changes in the exchange rate. Any changes in price will be explained clearly to you when made. 

COMPLAINTS If you have any complaint about your trip, you must make it known at the earliest opportunity to the guide, trip leader and/or A&L local representative, who will normally be able to take appropriate action. If at the end of the trip you feel your complaint has not been properly dealt with you must notify us in writing within 30 days of the end of your trip.

A&L will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or non-performance of any of its obligations under this agreement to the extent that any such delay or non-performance is due to any Force Majeure. “Force Majeure” means any circumstances beyond our reasonable control, including without limitation acts of nature and/or God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labour strikes, requisition, sickness, quarantine, pandemics, epidemics, diseases and viruses that are known, unknown or novel such as coronavirus/COVID-19 (including any spread thereof), government intervention of any kind including those that affect domestic and/or international travel, border closings, border limitations, border restrictions, weather conditions, and other unforeseen circumstances. 

FORCE MAJEURE: If Force Majeure prevents, significantly hinders, or makes it impossible for us or our third party suppliers to provide the trip we shall be entitled to, and may in our complete and sole discretion, vary, delay, postpone, alter or cancel any itinerary or arrangement in relation to the trip, including the entire trip itself. We, in our sole discretion, may give you a credit with certain terms and restrictions that can be used to book one of our trips, or reschedule yours within 12 months of your original departure date. The credit is subject to inflation and Argentine Peso depreciation. We may also change the action that we choose to take in our sole and complete discretion. For instance, if we rebook you on another departure but decide to issue a travel voucher, we may replace the rebooking with the voucher. 

If we are affected by Force Majeure, we, if practicable, will notify you of the nature and extent thereof.

If A&L cancels a trip  within 30 days prior to trip departure due to non-force majeure circumstances, A&L will do its best to refund payments received (less bank fees and exchange rate differences), but will not be obligated to provide any refunds and cannot guarantee any refunds, full or partial.  The reason for this is that within 30 days of departure date, there are costs, including unrecoverable thirdparty deposits (monies we have sent on to third parties to deliver your trip) and other trip fees and expenses, that A&L cannot recover. 

IMPORTANT NOTE REGARDING ANY REFUNDS. Exchange rate differences and Argentina’s Central Bank forex restrictions apply to any refund as payments are received in Argentine Pesos, hence it is not possible to acquire the amount of USD originally sent. Moreover, there are bank wire charges. As a result, once the trip has been fully paid, we cannot provide a full refund or credit under any circumstances as any refund under this agreement will be reduced by bank charges, differences in currency exchange rates, and unrecoverable deposits and costs that we have incurred

PASSPORT AND VISAS It’s the travellers’ responsibility to carry a valid passport and have obtained the appropriate visas when traveling with A&L. Please ensure that your passport is valid for 6 months beyond the duration of your holiday.  A&L shall not be responsible for any delay, interruption or cancellation resulting from client’s failure to provide required documentation to immigration or other authorities at any time. Travelers should check with their local and Argentine immigration office to find out if they need a visa or must pay a reciprocity fee online before leaving their country of residence. 

HEALTH, FITNESS AND AGE LIMITS Travellers must advise A&L of any pre-existing medical condition and/or disability that might reasonably be expected to increase the risk of you requiring medical attention, or that might affect the normal conduct of a tour and the enjoyment of other trip members.  

To participate in certain activities travellers will be asked to sign a Risk Assumption Form.

MOUNTAIN ALTITUDE Some of our active trips take place at altitudes you may not be used to. Extreme altitude is inherently risky, so proper medical advice should be sought in good time before booking if partaking in activities such as mountain climbs or high-altitude hikes and treks (usually above 3,500 m.a.s.l.). 

SPECIAL REQUESTS Clients should advise A&L of any special request (for example: special diet or on account of physical disability) at the time of enquiry or submitting a reservation. A&L will do its utmost to meet such requests wherever possible.

GOVERNING LAW This agreement will be governed by and construed in accordance with the Law of Argentina and each party agrees to submit to the exclusive jurisdiction of the courts of Argentina.
